Who Can Qualify for DACA?

Individuals, also known as “dreamers”, typically qualify for DACA (which stands for Deferred Action for Childhood Arrivals). The general requirements for DACA include the following:

You came to the U.S. When you were younger than the age 16.

When you arrived in the U.S., you were not inspected by customs.

On June 15, 2012, you were younger than 31 years of age.

On June 15, 2012, you were physically within the U.S.

you are currently within U.S. Borders and will be when applying for DACA

You have never been convicted of a felony or serious misdemeanor.

You are currently attending school, have graduated high school, have earned a GED, or were honorably discharged from the U.S. Military.

To get a better sense of your eligibility for DACA, it is recommended you speak with a DACA lawyer.

Applying For DACA

It is still possible to apply for deportation protection under DACA, but please note that applications are not currently being processed or granted by the government.

Renewing Your DACA Application

If you applied, and were approved, under the DACA program, it is important to understand that your DACA status needs to be renewed. You should file for renewal at least 120 days before the expiration date to ensure there is no lapse in your approval status. In addition, DACA renewals may be processed up to one year after expiration.

Do You meet the Criteria?

Why You Might Want to Renew Your DACA Application

USCIS may still process DACA renewal applications. A DACA renewal immigration lawyer can help ensure you meet the following criteria:

You’ve resided in the U.S. since your most-recently-approved DACA application
You have not left the U.S. since August 15, 2021
You have not been convicted of any criminal offense or offenses that would impact your eligibility for the program.
