To be eligible for SIJS in California, a court must make a formal determination that the undocumented minor, aged 0-18, was abused, abandoned, or neglected by one or both of their parents.

The court must also determine that reunification with the undocumented minor’s parent(s) is not viable due to abuse, abandonment and/or neglect.

Lastly, the court must find that it is not in the minor’s best interest to return to his or her country of nationality or last habitual residence.

These three determinations are critical in allowing the minor to apply for Special Immigrant Juvenile Status with the United States Citizenship and Immigration Services (USCIS).
